TERMS AND CONDITIONS

Please read these Terms and Conditions (the "Terms") carefully. By accessing https://FCHEATS.COM/ (the "Site") and/or purchasing and using the software, digital products, and services provided by the Site (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy.

"FCHEATS" is a project managed by IE Polyakov A.M., registered under the laws of the Russian Federation (hereinafter referred to as "we", "us", "our", or "FCHEATS"). These Terms create a legally binding agreement between FCHEATS and you (the "User", "you").

If you do not accept these Terms and Conditions in their entirety, you must strictly refrain from using the Site and Services.

1. DEFINITIONS

  • "Account" means a personalized profile created by the User to access specific features of the Site and Services.
  • "Intellectual Property Rights" means any intellectual property related to the Services, including but not limited to source code, scripts, software components, website design, UI/UX, databases, trademarks, and trade secrets, whether registered or unregistered.
  • "Services" means the provision of access to game modification software, digital products, news, customer support, and entertainment content available through the Site. FCHEATS operates as a marketplace and reseller; therefore, certain software provided may be developed and owned by third-party creators.

2. ACCOUNT REGISTRATION AND SECURITY

To use certain Services, you must register for an Account.

  • Accuracy of Information: You warrant that all information provided during registration is current, complete, and accurate.
  • Single Account Policy: You are permitted to register and maintain only one (1) Account.
  • Account Security: You are strictly responsible for maintaining the confidentiality of your login credentials. FCHEATS is not liable for any unauthorized access to your Account.
  • Account Transfer: You may not sell, trade, gift, or transfer your Account to any other person or entity under any circumstances.
  • Termination: You may cancel your Account at any time by contacting support@fcheats.com. FCHEATS reserves the right to monitor, suspend, or terminate your Account at our sole discretion for any violation of these Terms.

3. ACCEPTABLE USE POLICY

By accessing the Site and Services, you agree NOT to:

  1. Use automated scripts, "bots", "spiders", or "scrapers" to access, copy, or monitor any portion of the Site.
  2. Attempt to reverse-engineer, decompile, or bypass the security systems, authentication measures, or navigational structure of the Site or provided software.
  3. Use the Services for any unlawful purpose or in violation of any local, state, national, or international law.
  4. Engage in any form of harassment, abuse, defamation, or discrimination against other Users or FCHEATS staff.
  5. Upload or distribute malware, viruses, or any malicious code through the Site's communication channels.
  6. Share personal or identifying information about other Users without their explicit consent (doxxing).

FCHEATS reserves the right to immediately terminate access without refund for any User found violating this Acceptable Use Policy.

4. PAYMENTS AND SUBSCRIPTIONS

  • Fees: While browsing the Site is free, access to specific software and modded content requires payment. Fees are structured primarily on a subscription basis (e.g., 1 to 30 days of access) or a one-time purchase basis, as specified on the respective product page.
  • Payment Methods: We employ secure, third-party payment gateways (Payment Processors) to handle transactions. By making a purchase, you agree to the terms and conditions of the selected Payment Processor. We do not store your credit card or sensitive financial data.
  • Taxes and Surcharges: The User is responsible for any applicable regional taxes or processing fees imposed by their chosen payment method.

5. REFUND POLICY

Due to the digital and consumable nature of the Services, all sales are final. We offer refunds only under the following strict conditions:

  • FCHEATS' Fault: If we are completely unable to deliver the purchased Service due to an error on our end, you are entitled to a full refund.

No refunds will be issued under the following circumstances:

  • The User's computer fails to meet the minimum system requirements for the software.
  • The User refuses to follow the setup instructions or rejects the technical support recommendations provided by our team.
  • The purchased software or tool is temporarily offline for maintenance or in "Update" status (this is a normal part of game modification and is clearly stated on product pages).
  • The User has partially utilized the prepaid subscription period.
  • The User's game account is banned or suspended by third-party game publishers (use of modifications is strictly at your own risk).

To request a refund under valid conditions, contact support within the active subscription period. Approved refunds may take up to thirty (30) calendar days to process.

6. INTELLECTUAL PROPERTY AND LICENSING

  • Site Content: All original content on the Site (text, graphics, logos, Site structure) is the exclusive property of FCHEATS.
  • Software Licensing: Purchasing a Service grants you a limited, non-exclusive, non-transferable, and revocable license to use the software for personal, non-commercial entertainment purposes only. You are not acquiring ownership of the software.
  • User Feedback: If you submit reviews, ideas, or suggestions ("Feedback") to us, you grant FCHEATS a perpetual, irrevocable, worldwide, royalty-free license to use, publish, and commercially exploit that Feedback without compensation to you.

7. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

Use at Your Own Risk: The Site and Services (including all third-party software provided) are delivered on an "AS-IS" and "AS-AVAILABLE" basis.

  • No Warranties: FCHEATS expressly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or 100% secure from detection by third-party game anti-cheat systems.
  • Limitation of Liability: To the maximum extent permitted by applicable law, FCHEATS, its owner, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, hardware damage, or the loss/banning of personal gaming accounts arising from the use of our Services.

8. DISPUTE RESOLUTION AND GOVERNING LAW

  • Amicable Resolution: In the event of a dispute, you agree to first contact us at support@fcheats.com to attempt to resolve the issue informally within sixty (60) days.
  • Governing Law and Jurisdiction: If the dispute cannot be resolved through negotiation, it shall be governed by the laws of the Russian Federation. Any legal actions or proceedings shall be brought exclusively before the competent courts located in Moscow, Russian Federation.

9. FINAL PROVISIONS

  • Severability: If any provision of these Terms is deemed unlawful or unenforceable by a court of competent jurisdiction, that specific provision shall be severed, and the remaining provisions will continue in full force and effect.
  • Force Majeure: We shall not be held liable for any delay or failure to perform our obligations if such failure results from events beyond our reasonable control (e.g., acts of God, war, server outages, infrastructure failures, or government restrictions).
  • Waiver of Rights: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Amendments: FCHEATS reserves the right to modify these Terms and Conditions at any time to reflect operational or legal changes. Continued use of the Site after such changes are posted constitutes your acceptance of the revised Terms.
